Terms of Service Effective Date: December 1, 2022
Welcome to Alberta Tree Farms (“we,” “our,” “us”). These Terms of Service (“TOS”) govern your use of our website, products, and services. By accessing or purchasing from our site, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Use of Website & Services
1.1 You must be at least 18 years old or have parental consent to use our website and services. 1.2 You agree not to misuse, copy, or modify our website content without permission. 1.3 Unauthorized use of our website, including hacking or distributing malware, is strictly prohibited.
2. Orders & Payments
2.1 All orders are subject to availability and approval. 2.2 Prices are listed in Canadian Dollars (CAD) and may change without prior notice. 2.3 Accepted payment methods include credit/debit cards, e-transfers, and other secure payment systems. 2.4 Orders are only confirmed after full payment is received unless otherwise agreed upon. 2.5 We reserve the right to cancel or refuse any order at our discretion.
3. Late Payment Charges (For Business Clients & Bulk Orders)
3.1 Payment terms for approved business accounts may be Net 30 (payment due within 30 days of the invoice date). 3.2 A late fee of 5% per month will apply to overdue invoices. 3.3 If an invoice remains unpaid for 60 days, we may suspend further orders and take legal action for debt recovery. 3.4 Customers must notify us within 7 days of invoice issuance if they dispute any charges.
4. Returns & Refund Policy
4.1 Live Trees & Plants: All sales are final. Returns are not accepted once a tree has left our farm. 4.2 Non-Living Products (e.g., tools, supplies): Can be returned within 14 days of purchase if unused and in original condition. 4.3 Refunds are issued only for defective or incorrect products and must be reported within 48 hours of delivery. 4.4 Orders canceled within 72 hours of purchase fulfillment will incur a 25% restocking fee.
5. Shipping & Delivery
By placing an order, you agree to our Delivery Policy regarding shipping costs, timelines, and site conditions.
5.1 Delivery Areas: We deliver within Alberta and select Canadian provinces upon request. International shipping is not available. 5.2 Estimated Delivery Timeframes:
- Alberta deliveries: 3-7 business days.
- Out-of-province deliveries: 7-14 business days.
- Large or custom orders: Additional processing time may apply.
5.3 Customer Responsibilities:
- Ensure that the delivery site is accessible for trucks.
- A responsible person must be available to accept the order.
- If delivery is unsuccessful, a re-delivery fee may apply.
5.4 Waiting Time Charges: An additional fee of $176.00 will be charged for every 30 minutes the driver is required to wait beyond the initial 30 minutes at the delivery site due to circumstances attributable to the client.
5.5 We are not liable for delays due to extreme weather, supplier issues, or unforeseen circumstances (force majeure events).
6. Tree Warranty
6.1 One-Year Warranty for Retail Orders: We offer a one-year warranty on trees purchased at retail prices, provided they are properly cared for by the customer.
6.2 Extended Warranty for Trees Planted by Alberta Tree Farms Team: Trees that are planted by our professional team qualify for an extended warranty as outlined in our planting agreement.
- Follow provided planting and care instructions.
- Water and maintain the tree according to best practices.
- Provide proof of purchase.
6.3 No Warranty on Wholesale Priced Products: Wholesale orders are sold as-is and do not qualify for any warranty coverage.
6.4 Warranty Exclusions: The warranty does not cover:
- Damage caused by improper planting, neglect, extreme weather, pests, or animal interference.
- Trees that fail due to soil conditions or lack of water.
- Any trees planted outside of recommended hardiness zones.
6.5 Claims Process: Warranty claims must be submitted within the warranty period with photos and a written description of the issue. Approved claims will be eligible for a replacement tree or store credit at our discretion.
6.6 No Cash Refunds: Replacements or store credit will be provided; cash refunds are not available under this warranty.
7. Plantation Services Liability
7.1 Liability Disclaimer: Alberta Tree Farms provides tree planting services with professional care, but we are not liable for tree health or survival after planting unless covered by our extended warranty.
7.2 Client Responsibilities: Clients must ensure that:
- The planting location is suitable for the tree species.
- Proper watering, fertilization, and maintenance are performed post-planting.
- The site meets local municipal or environmental regulations.
7.3 Limitation of Liability: We are not responsible for damages due to:
- Improper post-planting care.
- Soil conditions affecting tree health.
- Damage from pests, wildlife, or environmental conditions beyond our control.
7.4 Underground Utilities & Site Preparation: Clients are responsible for ensuring that underground utilities, irrigation systems, or property infrastructure are properly marked and identified before planting. Alberta Tree Farms is not liable for any damages resulting from incorrect or incomplete site information provided by the client.
8. Privacy & Data Protection
8.1 By using our website, you agree to our Privacy Policy regarding data collection and protection. 8.2 We collect only necessary personal information for order processing and do not share or sell data to third parties. 8.3 Customers have the right to access, update, or delete their personal data upon request.
